Yeah it's literally the 4th Amendment, "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized".

Troops are civil servants who have an oath to protect US citizens, and they're actually held accountable by a military justice system.

Police are a private militia, hired by local municipalities, and it's been upheld multiple times, even by the Supreme Court, that they do not actually have any duty to protect or serve the public.

There was a court case exactly about this. Cops tried to enter and use a persons home to surveil a neighboring property. They sued on 3rd amendment violation grounds and won. Apparently the court thought it didn't just apply to military troops.

Yeah I think that's actually the more relevant amendment. These officers aren't searching her property. They're using it as a staging ground to conduct a (supposed) law enforcement action in adjacent public roads. Even if she's wrong to say they need a warrant, she absolutely can refuse them standing on her property.

What does the law say?

In England, if you have a sign that says "Dangerous dog, do not enter" and someone enters, and your dog bites them - you are liable because you knew you had a dangerous dog.

I fear a similar thing will be used in the states. "Ice not welcome" may simply become a welcome sign if not done right.

I know these 2 things are different. But it's more about how the signage is written and construed. Especially in the state of the USA right now where the GOV will win...

They are together in uniform maskless laughing and joking. At the beginning they arent concerned with the video. The person taking it is laughing along with them.

Then he starts antagonizing them. Saying he has their faces and they should laugh now.

What's even crappier is that the mods that ban people for silly things like you got banned for are AI bot automods, and when you file an appeal, they typically don't reverse the bans because AI is reading your appeal and not an actual human, and AI doesn't understand actual offensive stuff versus jokes or satire. I got banned for harassment recently for calling someone an idiot, which, if that's something they consider harassment, then half of reddit needs to be banned. To add to the silliness of my ban, that person said things about me which were worse, and yet they didn't get banned at all when I reported them. Reddit has truly gone down in quality.

No, this was last month in Saint Paul, not during COVID. Two days before Thanksgiving ICE was trying to get access to a home for an abduction. Hundreds of community members showed up to observe, and the Saint Paul police came out to protect ICE agents, who had lied about being attacked. The gas mask is because they intended to, and did, use pepper spray and tear gas on the protestors that showed up. That was despite the city stating that the police would not assist the feds with immigration raids. People, this neighbor included, were rightfully pissed off.

If you are wondering how this happens, it is an unofficial policy that a lot of places in the suburbs and business districts have with the police, where they remove people they just don't want around. If a business owner or homeowner calls, the police just show up, ticket them and slam them in jail to keep them from 'annoying' people. They do this to exclusively the minorities and homeless in a lot of major cities. AND IT IS IS EXTREMELY UNCONSTITUTIONAL. I cannot say this enough, you cannot be arrested simply for standing around on public property, and in most states, they cannot even legally ask for your ID.

The funniest thing is that a bunch of youtubers now go around the country setting up cameras in hotspots fishing for amendment violations, and some have made a LOT of money doing it, because you actually cannot remove someone for just filming, or standing around on public sidewalks, even if the city has outlawed it, those are protected acts by our constitution.

ICE and local police are going to be eaten alive once the lawsuits start pouring in, this is so fucked, but a lot of lawyers and citizens are going to make a lot of money off it once this current administration is out.

Exercising your 2nd amendment rights in this scenario may also be a way to lose your 1st amendment right (to your own life).

They're breaking the 4th and arguably the 3rd amendments, here. I don't trust them to not take me down right then and there if I were even hinting at myself owning a firearm, let alone have one on my person.

You should be able to exercise your 2nd safely. But we are currently under an Admin that could give less than two fucks about the Constitution they all swore an oath to uphold and defend. They're breaking one, maybe two, in the Bill of Rights on video, right here. What's another extrajudicial murder of some crazy leftist Antifa agitator who was obstructing justice and acting berate and possibly hiding illegal immigrants in her own home (not my view; this is what the defense would be if this video took a turn for the worst).

Well, it depends. 

There is no law without the use of violence to enforce it. You can stay there and talk until you're blue in the face, and they will still continue to be in her yard, violating her right under the law. Why? Because there is no threat of physical force being applied to them. 

This is literally an example of where, if we were willing to actually read what the Constitution says and apply the language as it was used at the time, the Second Amendment is applicable. 

"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed".

What does "well regulated" mean, using the language and context of the 1770's colonial English language? It doesn't mean what we take it as today - a government body providing oversight. At that time, the word "regulated" meant to be, in modern English, standardized. For example, a British soldier in the standing army was called a: "regular". They still use the term to this day, to differentiate between professional full-time soldiers and reserve units. In the 1700's, most military forces consisted of a few people who made warfare their profession, and in times of war, would be filled out by conscripts and duty-men. 

In the context it was written, "well regulated" meant having the guns necessary to be a threat - pitchforks and shovels aren't enough, that would be "poorly regulated". 

So, to modernize the language of the Second Amendment: You can't have a free society unless you and your neighbors can band together against a tyrannical armed force using weapons of sufficient firepower; therefore, you and your neighbors have the right to keep and bear modern "military-grade" weapons.

Now, imagine instead of people arguing about this with their bold words, each of the neighbors walked out armed. It stops being some easily-ignored begging and pleading, and gains the true force of law. 

Now we are talking "The Consent of the Governed". Now we are talking about the Tree of Liberty. Now we are channeling Madison, Jefferson, Franklin, Paine. 

Now the 4th Amendment stops being fucking words on paper, and becomes LAW - an idea that's worth dying for, a New Hampshire state motto. 

I abhor violence. I wish that this was a world in which logic, reason, and compassion were the solution to all challenges. But as they say, you can wish in one hand and shit in the other - and reality will fill one up. 

When those who claim the authority of the State, and in the same act violate the very authority they claim, they are tyrannical. A Republic can only exist if the Governed holds the State accountable. 

So, the real answer to your question is: Her rights don't exist, and are therefore ignored, until they are enforced.

They don't need a warrant because there is no one willing to enforce the law that they need a warrant. Americans are discovering that all their laws are actually worthless if they are selectively enforced, or the state has amassed so much power it doesn't see a need to enforce laws on itself.

We're discovering that up until this point, law and order relied on good faith, and that when that good faith is tested, enforcing all the laws we have is an actual logistical nightmare.

It's like if there's one cop while 1000 people are speeding on the highway. We just expected everyone to obey the speed limit for their own safety, but one person saw another person doing it without facing consequences, so we monkey-see-monkey-do'd ourselves into the erosion of common law.

I think this is related to the George Floyd murder in 2020. The governor had issued an emergency and deployed the national guard under his orders. I don't know what her rights are in this circumstance; curfews had been ordered. This is very different from what is happening with ICE today.
